1. Definitions

• "Belvilla," "we," "us," "our" refers to Belvilla B.V. and its affiliates.
• "Platform" refers to the Belvilla website, mobile applications, and related services.
• "Guest" or "User" refers to anyone who uses our Platform to search for or book vacation rentals.
• "Host" or "Property Owner" refers to individuals or entities who list properties on our Platform.
• "Property" or "Accommodation" refers to vacation rentals listed on our Platform.
• "Booking" refers to a confirmed reservation for a Property.

2. Acceptance of Terms

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Belvilla.

You must be at least 18 years old and have the legal capacity to enter into contracts to use our services.

3. Our Services

Belvilla provides an online platform that connects Guests with Property Owners. We facilitate:

• Property search and discovery
• Booking and reservation management
• Secure payment processing
• Communication between Guests and Hosts
• Customer support services

Important: Belvilla acts as an intermediary between Guests and Hosts. We do not own, manage, or control the properties listed on our Platform. The Host is solely responsible for the property and the services provided during your stay.

4. Account Registration

To book a property, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

5. Booking and Payment

5.1 Making a Booking

When you make a booking, you enter into a direct contract with the Host for the rental of their property. A booking is confirmed when you receive a confirmation email from Belvilla.

5.2 Pricing

Prices displayed include the accommodation cost and may include additional fees such as:

• Service fee (charged by Belvilla)
• Cleaning fee (set by the Host)
• Security deposit (refundable)
• Local taxes (where applicable)

5.3 Payment

Payment is processed securely through our Platform. We accept major credit cards, PayPal, and bank transfers (for select bookings). Full payment or a deposit may be required at the time of booking, with the balance due before check-in.

6. Cancellation Policy

Cancellation policies vary by property. The applicable policy is displayed on the property listing and in your booking confirmation. Common policies include:

• Flexible: Full refund up to 24 hours before check-in
• Moderate: Full refund up to 5 days before check-in
• Strict: 50% refund up to 7 days before check-in
• Non-refundable: No refund for cancellations

Service fees may be non-refundable depending on the circumstances. We recommend purchasing travel insurance for added protection.

7. Guest Responsibilities

As a Guest, you agree to:

• Respect the property and its contents
• Follow house rules set by the Host
• Not exceed the maximum number of guests allowed
• Not use the property for commercial purposes or illegal activities
• Leave the property in reasonable condition
• Report any damages or issues promptly
• Comply with local laws and regulations

8. Liability and Disclaimers

8.1 Platform Liability

Belvilla is not responsible for the condition, safety, or legality of properties listed on our Platform. While we verify listings, we cannot guarantee the accuracy of all information provided by Hosts.

8.2 Limitation of Liability

To the maximum extent permitted by law, Belvilla's liability is limited to the service fees you paid for the booking in question. We are not liable for indirect, incidental, special, or consequential damages.

9. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Belvilla or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

10. Dispute Resolution

In case of a dispute, we encourage you to contact our customer support team first. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with the rules of the Netherlands Arbitration Institute (NAI).

11. Governing Law

These Terms of Service are governed by the laws of the Netherlands. Any legal proceedings shall take place in the courts of Amsterdam, Netherlands.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective upon posting to the Platform. Continued use of our services after changes constitutes acceptance of the new terms.
